Arizona Lawsuit Says Store Owners Cannot Shiled Themselves from Liabiity by Hiring Security Contractros

In a recent court case in Arizona that may have implications here, the Courts have ruled that a store owner may not shield themselves from liability by saying the act which harmed another was caused by employees of a contractor (such as a private security firm) who did the hiring.

The case involves a shopper at a Safeway store who sued Safeway after a private security officer employed by a firm hired by the store "physically and sexually assaulted" him after mistakenly thinking he had shoplifted.

Safeway defended themselves in part by claiming that they officer was not their employee and they could not be responsible for his actions.

The Courts disagreed, saying that Safeway had assumed the obligation when they chose to hire a security firm:

Here Safeway did not initially have a specific, nondelegable duty to provide security services. Instead, it voluntarily assumed that duty within the context of the heightened duty it already owed to its business invitees. Having [voluntarily] assumed the task of providing security services on its premises, Safeway thus created for itself a personal, nondelegable duty to protect its invitees from the intentionally tortious conduct of those with whom it had contracted to maintain a presence and provide security on its premises. Safeway cannot now disclaim liability merely because the individuals it permitted to interact so closely with its customers had been hired by an independent contractor. Were we to hold otherwise, the potential for abuse would be great. Therefore, we hold that when, as here, a business owner assumes a duty to provide security services, that duty is nondelegable, and the owner will not be insulated from liability for the tortious acts of security personnel hired as independent contractors.

CALSAGA member served with class-action lawsuit

CALSAGA was recently made aware that a long-time member company of ours, Bomar Security and Investigations, was served a class-action lawsuit from a former employee claiming they were not compensated for pre-employment state mandated security officer training time. This contradicts a recent opinion issued by the Department of Labor Standards and Enforcement (DLSE) that concluded pre-employment training was not compensable.

Obviously, we don’t know the facts and circumstances of this case, but its implications are enormous for our industry.

Click here to find a letter authored by Tony Sabatino from Securitas Security Services that was sent to Mitzi Navarro, President of Bomar Security & Investigations. The reason why we are distributing this letter to the entire membership is to bring attention to an issue that threatens every PPO in California.

Obviously, this latest challenge is particularly concerning, specifically because the lawsuit seeks to dispute the DLSE ruling. With employers already at risk for wage-hour class action lawsuits as it pertains to meal and rest breaks, we believe this latest development only exacerbates the problem and increases the overall exposure for employers across the state.

CALSAGA will continue to advocate for reform here in Sacramento, but your involvement will be absolutely essential. In February, CALSAGA will be hosting meal and rest break seminars on Tuesday, February 12 in Sacramento and Wednesday, February 13 in Cerritos. It is our hope that these seminars provide a forum for information sharing, while uniting our industry to help resolve one of the most serious issues currently facing our industry.

State assembly passes health care legislation

Just when the special legislative session appeared to be fruitless, the Assembly passed a $14.4 billion health care reform plan today on a party-line vote, 45-31. The bill would provide coverage for most uninsured Californians.

Assembly Republican Leader, Mike Villines (R - Clovis) said the bill was "more public relations than policy" while Speaker Fabian Nunez (D - Los Angeles) countered by saying it was not just a publicity stunt. Regardless, the Senate isn't expected to vote on the bill anytime soon, most likely not until the beginning of the year after Governor Schwarzenegger releases his 2008-2009 budget proposal.

CALSAGA meets with key government appointees

On Tuesday, December 11, CALSAGA representatives including Deputy Association Manager, William Hodges, Tony Sabatino from Securitas Security Services and CALSAGA lobbyist, Kelly Jensen met with the Governor's Secretary of Legislative Affairs, Chris Kahn and Carrie Lopez who is the Director of the Department of Consumer Affairs (DCA).

In our meeting with Kahn, CALSAGA thanked him and the Governor for signing CALSAGA sponsored legislation, Senate Bill 666 and vowed to work with the Administration on a new bill in 2008 that would give BSIS authority to enforce and develop minimum training standards for proprietary security officers.  CALSAGA also discussed the meal and rest break issue and Kahn reiterated that the Governor's position remained the same - that they would like to see a universal solution that would provide relief for everyone.

In our meeting with Carrie Lopez, she explained that DCA was planning on rolling out a marketing campaign aimed at getting consumers to understand what is behind a license - that having a license means something.  We also discussed our desire to work with them on a follow up bill to Senate Bill 666.  Additionally, CALSAGA expressed interest in working with their department to find ways to attract more worker's into the system.

All said, it was a successful day.

Schwarzenegger backs remapping overhaul

Governor Arnold Schwarzenegger announced today that he will lead a statewide campaign to qualify an initiative for the November 2008 ballot that would change the way political districts are drawn.  The Governor is touting the move as a much-needed fix to increase competition in California's legislative seats, as only 1 congressional seat and not a single legislative seat has changed hands since Democrats and Republicans made a deal in 2001.
