Private Patrol chase in Sacramento is bad for industry image

On Monday, November 26, the local Fox affiliate in Sacramento ran a story on a private patrol operator who chased down a suspect at a high rate of speed through the streets of Sacramento during the commute hour with full lights flashing.

The company at fault here, DWB Security is not a CALSAGA member.  From our perspective though, a story like this hurts our credibility and only feeds negative stereotypes about our industry.  What do you think?  Even though the California Business & Professions code is very clear about the role of private security, is there more that can be done to discourage this type activity?

CALSAGA to host meal and rest break seminars in January

In response to the growing concern over meal and rest break lawsuits that are being filed against employers, CALSAGA will hold two seminars for members in January to discuss the issue in great detail.  What are your risks?  What can you do if a lawsuit is filed against your company?  These questions and more will be answered.

The current plan is to host events both in Southern and Northern California, and we are working to schedule speakers that are closest to the issue, including Laura Innes from Simpson, Garrity & Innes and Mike Prosio, Deputy Legislative Director for Governor Schwarzenegger. 

We'll have more information in the coming weeks, as we confirm the dates, locations and speakers.

Twin Falls, Idaho Regulations Remind Us of Need for State-Level Regulation

The article in the Daily News Clips today about the city of Twin Falls, Idaho adopting city-level regulation of private security firms is a good reminder that state-level regulation, as we have in California, is a far better model.

There is nothing wrong with Twin Fall's stated reason for the need to regulate the firms.  But imagine if that trend took hold in California.  If, for example, Pasadena, Glendale, and Burbank each had different ruules and regulations for security firms and security officers, a company might be allowed to work in one city, but not another.  You might have to keep track of different training or uniform or licensing rules for each city, and perhaps certain officers of yours might be able to work in one city, but not another.

It would be an administrative nightmare.

That is why we are lucky to have state-level regulation of security here in California, and why CALSAGA has aggressively responded to any city-level regulations and encouraging BSIS to continue to assert state pre-emption on undue city regulation of our industry.

Recently, CALSAGA worked with the City of Oxnard in responding to draft regulations their City Council had discussed, some of which would have intruded on the state's realm of regulating security.

If you are aware of city level regulations that you believe cross the line into the areas that are supposed to be covered only by the state, let us know.

Recap of Day 2 at the 2007 CALSAGA Annual Conference

On the second day of the conference, California Chamber of Commerce President Allan Zaremberg started the morning off and spoke on mandated healthcare and the potential impact it could have on the business community.  Additionally, Zaremberg spoke about the importance of the business community getting involved in the political process, as it relates to political contributions and how those contributions send a message that your industry desires to be a major player in Sacramento.   

One of the highlights of the second day was two presentations on the issue of meal and rest breaks from Mike Prosio who is the Chief Deputy Legislative Secretary to Governor Schwarzenegger and Laura Innes from Simpson, Garrity & Innes. 

Prosio gave the viewpoint from the Governor’s office and explained how the Governor would like to see a universal solution to the meal and rest break issue, as opposed to an industry-by-industry fix.  Prosio applauded our industry and CALSAGA for meeting with him throughout the past year and he encouraged the same dialogue again in 2008. 

As many of you know, Innes spoke at our Annual Conference last year, so it was good to have her back once again to give a legal perspective on the issue.  Innes cited several recent cases on meal and rest breaks, including the recent Brinker Restaurant Group v. Supreme Court case.  Click here to view her PowerPoint presentation.

Because this is such an important issue, we may ask Innes and others to participate in a meal and rest break forum in early 2008 to discuss further.

Wrapping up the day, we were fortunate enough to have Sacramento Police Chief Albert Nájera join us at lunch to talk about enhancing the relationship between law enforcement and the private security industry.  Chief Nájera explained that law enforcement has been working with BSIS on educating police officers on the different types of security officers, and what to look for with regards to licensing and training.

The program ended with a panel discussion with BSIS Chief Paul Johnson, Deputy Chief Rick Fong and Cathy Kester from the Department of Justice (DOJ).  Johnson gave attendees an update on the latest from BSIS and mentioned that their agency has stepped up enforcement throughout the State – most recently taking part in a joint sting operation with the Oxnard Police Department, where several security officers and a PPO were cited for not complying with State licensing and training requirements.  Kester finished off the panel by explaining the guard card licensing process from the perspective of DOJ and what challenges her department has encountered.

Legislative Analyst says state budget shortfall will grow to $10 billion

Recap of Day 1 at the 2007 CALSAGA Annual Conference

The program portion of the conference began on Wednesday, November 7 with CALSAGA President Mark Miller kicking off the program with some opening remarks and recapping our Association’s progress in 2007 and how we plan to move forward in 2008.  California Labor Commissioner Angela Bradstreet followed Miller and spoke candidly about the meal and rest break issue and how her agency has taken steps to gather necessary information in hopes of finding a solution in the near future.

CALSAGA was thrilled to have motivational speaker Rory Aplanalp present “How to Be Proactive in a Reactive World.”  Aplanalp is an accomplished author, consultant and professional speaker.  He gave a very entertaining presentation that involved the entire room, not to mention the fact that it was a nice respite from the program.

Some of the other first day highlights include a presentation by Tony Sabatino, President of Southern California/Hawaii Region of Securitas Security Services who officially launched CALSAGA’s new marketing plan.  Sabatino outlined the steps that are needed to create greater exposure for our Association and industry and how we must control how elected officials, consumers and the public perceive private security.

The greatest news is that we already have a start on our marketing efforts.

For those who weren’t in attendance, Sabatino presented CALSAGA Marketing Chair, Lorraine New with a $50,000 check from Securitas Security Services, which will act as half of a $100,000 marketing budget for 2008.  CALSAGA is hopeful that the other $50,000 will be raised from other member contributions.  CALSAGA applauds Securitas Security Services for their commitment and are confident that this is just the beginning in a sustained marketing effort.

BSIS Enforcement Manager, George Paddeck and Outreach Coordinator, Rolando Taeza participated in a panel to discuss AB 2880 training compliance.  Much like the AB 2880 seminars held earlier in the year by CALSAGA, this was a very interesting topic for attendees and lots of questions were asked from the audience.  Taeza told attendees to “train your security officers, or we’ll be knocking at your door!”

To wrap up the first day, our Security Officer Memorial Fund Cocktail Reception was held at the Pyramid Alehouse and we are happy to report that roughly $8,000 was pledged this year!  We had a nice assortment of donated items for the silent auction and various raffle prizes as well.  Thank you to everyone who attended and/or made a pledge.  The money that we raised goes entirely to the families of fallen security officers killed in-line-of-duty.  Judging by the smiles on faces, we are confident that everyone had a good time at the reception!

CALSAGA celebrates yet another successful Annual Conference in Sacramento

The 2007 CALSAGA Annual Conference has come and gone, but for the nearly 200 people that were in attendance, we know that the information you took from the conference was invaluable.  Leaders from the security industry, state agencies and the private security industry converged on the State Capitol from November 6 – 8 in what was arguably the most successful Annual Conference ever staged by CALSAGA.

The conference titled “Crossing the Bridge to a New Security Profession” explored the unique opportunity that is upon CALSAGA to promote our industry to consumers, the public and elected officials in an effort which we anticipate will better position ourselves for the future.

Prior to the start of the conference, CALSAGA hosted its first Annual Conference Golf Tournament on Tuesday, November 6 at Haggin Oaks Golf Course in Sacramento.  We had a small group of players, but everyone who did play thoroughly enjoyed themselves and we’ll definitely be bringing the event back next year – hopefully with a few more players!  Thank you to our golf sponsor The Mechanic Group for making the event possible.

Brad Antonioni from Trans West Security won lowest gross score with an 88 and Steve Davey, who is the Chief of Staff for Assemblyman Ted Gaines won lowest net score with 69.  Additionally, Bob Deale from Elizabeth Souther won longest drive with a drive of 285 yards and Mark Nagle won closest to the pin, which was a little over 8 feet from the pin on his tee shot!

Following the golf tournament, everyone joined us for a small award ceremony on the patio where prizes were distributed to each player.  It was a nice way to finish the afternoon with some laughs, food and drink with everyone.

In the evening of November 6, Association Manager Jeff Flint, through coordination with Assemblyman Ted Gaines’ office, led over 40 conference attendees through a tour of the State Capitol!  For those that were there, you know that you didn’t just get the basic tour.  Attendees were led onto the floor of the State Assembly, through the Senate Gallery and through the Member’s Lounge.  Apparently, the Member’s Lounge is very rare for the public to see, so much that many of the State Capitol staffers haven’t even seen it!

All said, this was the first attempt to stage pre-conference activities around our normal conference and I think we can all agree that it was an overwhelming success.  This is just the beginning, so look for more of these types of events at future conferences.

NASCO lends support to Background Screening Resolution

The National Association of Security Companies (NASCO) recently pledged their support to legislative admendments to the Private Security Officer Employment Authorization Act (PSOEA) that would permit security firms to access criminal history information from the FBI's national criminal databases.

According to the memo distributed by NASCO, certain states have not implemented a process of conducting searches via the FBI's national criminal database, pursuant to the PSOEA as currently enacted. NASCO plans to work with Congressman Robert Andrews (1st District, New Jersey) on these legislative admendments.
