Oxnard Police Department arrests 11 unlicensed security officers

In a press release distributed this morning, the Oxnard Police Department reported that they arrested 11 unlicensed security officers from United Security Services on August 12 for violating the California Private Security Services Act, which requires all contract security officers in California to posses a vaild guard card, undergo a criminal background check and complete a mandatory 40 hours of training.

CALSAGA understands that Oxnard Police Department reguarly works with the Bureau of Security & Investigative Services (BSIS) on enforcement activity in the city of Oxnard.  We applaud both agencies for their enforcement efforts, which undoubtedly goes a long way in professionalizing the industry while protecting public safety and consumers.

This is especially good news for all security firms and their employees in California that work hard to comply with State regulations.  Unlicensed activity does nothing but undermine those who are properly licensed and trained.

As many of you know, cracking down on unlicensed activity has been a priority of CALSAGA and BSIS for some time now.  The message from BSIS and local law enforcement is clear.  If you continue to operate a security firm without a proper license, put officers on post without a guard card, or fail to train your officers, you will evenutally face the consequences.

CALSAGA Legislative Day an overwhelming success

4th annual event further establishes CALSAGA as a major player in Sacramento

On Tuesday, August 22, CALSAGA legislative leadership and staff spent the day meeting with key legislators and staff on some of the more important issues facing the security industry, including meal and rest break reform, legislation the Association is looking to pursue in 2008 and CALSAGA sponsored Senate Bill 666.

Perhaps equally as important to our legislative goals, the Legislative Day was another opportunity for CALSAGA to meet with face-to-face with elected officials who make decisions that have a direct impact on our industry. Additionally, many of the meetings were with legislators that had previously supported SB 666, so it was an opportunity to thank them for their support.

On the meal and rest break front, CALSAGA met with Mike Prosio who is the Chief Deputy Legislative Affairs Secretary for Governor Schwarzenegger. Prosio explained that the Administration is still hopeful that an agreement will be brokered before the end of the legislative session, despite the relatively slow movement on the issue. If something were to get done, Prosio believed that the issue would need to gain traction within the next week or so.

Everyone involved recognizes that there is a problem, but the issue has become a political game of cat and mouse, with both sides wanting something in return for what they give up. Until that is determined, there is a high probability there will be no resolve to the issue this session. However, in the event something does break, there are several legislative bills that could be used to move the reform bill quickly through the Legislature and to the Governor’s desk for signature.

As mentioned, CALSAGA also discussed some of our future legislative goals with each member. Some of those ideas include, implementing tiered security officer classifications and legislation that would mandate security officers to return their uniforms to their employer once they no longer work with that particular company, or face a suspension of their license and/or monetary consequences. Again, these are just ideas, but CALSAGA believes both will continue to professionalize the industry and further protect the public and consumers.

On the SB 666 front, we reiterated our appreciation to those members who supported the bill thus far and told them we would keep them informed as it continues to move through the Legislature. Specifically, Assemblymember Mike Eng (D – Monterey Park) who is the Chairman of Assembly Business & Professions Committee was one of those legislators who remained patient when opposition began to arise on our bill and gave our lobbyist the time necessary to work out a solution with the opposition in order to keep the bill moving forward.

The day was a success and we received many positive remarks about CALSAGA and our lobbyist from legislators and their staff. All said, we met directly with four legislators and four key staff members representing other legislators and the Governor’s Office.

We will continue to keep you posted on any developments pertaining to our industry as the legislative session winds down.

California Legislature Finally Passes Budget

After much posturing and negotiating between Democrats and Republicans, the California Legislature finally passed a $103 billion budget this afternoon.  The agreement comes as great relief after nearly two months of stalemate between both parties. 

As you may recall, the State Assembly agreed on a budget on July 20, but the Senate Democrats had been unable to get two Republicans to break party and vote, as a 2/3 majority is needed in both houses to pass the budget.

Now that the budget has passed, legislators can now focus on legislative bills that have been essentially in a holding pattern since the budget negotiations began.  This includes CALSAGA sponsored legislation SB 666, which will mandate proprietary security officers to complete training requirements similar to that of contract security officers. 

The budget will now head to the Governor, which he is expected to sign later this week.  To read more about the budget, click here for an article recently posted in the Sacramento Bee.

Member Survey: Are Private Security Officers Being Attacked More Frequently?

After a rash of recent attacks in the Palm Springs area, local television news station KESQ-TV is highlighting the increase in assaults and attacks on private security officers in the Coachella Valley. 

The article on the TV news website says, in part:

Police say it's becoming a disturbing trend -- security guards being threatened and attacked by criminals.

Two security companies in the desert NewsChannel 3 spoke to both agree that security guards are being targeted more now than ever.

They say it's because of a lack of respect for what these men and woman do. What they're doing, they say, is trying to protect the community.

In May, two Bower Security guards were shot while patrolling a shopping center in Cathedral City.

On June 9th, a 66-year-old security guard was protecting a housing development when he was pulled from his car and beaten to death.

And just this past weekend, a security guard patrolling Time Waner Cable in Desert Hot Springs was carjacked.

CALSAGA wants to know whether members believe this is a growing problem throughout California, or isolated to the Palm Springs area.  CALSAGA has considered sponsoring legislation to increase penalties for attacking a security officer, and as a possible interim, to require BSIS to keep statistics to show whether attacks on private security are increasing.

What did school shootings in the last decade have in common? They happened in gun-free zones. Labor Commissioner Angela Bradstreet hosts public meal and rest break forum

Dlse_hearing_1_9Recently appointed California Labor Commissioner, Angela Bradstreet hosted a public forum today on the campus of California State University, Sacramento on the meal and rest break period.  Representatives from the employer community, members from organized labor and the general public all voiced their concern.

Joining Commissioner Bradstreet on the panel included Deputy Labor Commissioner Lupe Alvarez and Stephanie Watkins, who is the Legislative Director/Counsel for the Department of Labor Standards and Enforcement (DLSE). 

Through much of the early part of the meeting, there seemed to be some disconnect on what employers are seeking in the realm of reform, as several employees expressed concern that employers were attempting to take away their meal and rest break.  Thankfully, several employer representatives stepped up and made it clear that employers are only seeking clarification and flexibility in the law.

A representative from our staff was on hand to take notes in preparation for the next public forum that the Commissioner will be hosting on Thursday, August 9 at California State University, Northridge from 9:00 a.m. - 2:00 p.m.  CALSAGA will voice our concern on behalf of the private security industry and we encourage all members to attend and make public comments.  Click here for additional information on the August 9 event in Southern California.

We apologize to those members in Northern California who might have wanted to attend the forum in Sacramento, but the DLSE announced that they were going to hold these forum earlier in week, which really didn't give us much time to coordinate our efforts.

Brown Opinion Likely to Spark Badge Debate

California Attorney General Jerry Brown's decision to restrict the design of honorary sheriff's badges is likely to have far reaching implications that may affect badges worn by non-sworn law enforcement personnel as well as private security officers in this state.

The opinion, written by deputy Attorney General Marc J. Nolan, states that "An honorary badge should be as distinguishable as possible from badges used by peace officers". Nolan added " The more an honorary badge resembles an authorized peace officer badge in shape, markings and other indications.....the more likely the badge will deceive an ordinary reasonable person".

While the Attorney General's opinion specifically applies to honorary badges awarded by sheriffs, the language of Nolan's statement may be used in arguments to further restrict the design of badges of non-sworn law enforcement, and  also cause stirrings among those who favor tighter restrictions on private security badges. It is a deeply held belief among this group that an "ordinary reasonable person"can be easily fooled into believing that a badge that resembles anything other than a door bell is the badge of a sworn peace officer.

Unfortunately, what comes through in this kind of regulation is not the intent to readily distinguish between sworn peace officers and private security. But rather it is to warn the public about those who wear the oddly shaped badges. "Caution, the individual attempting to help you is not a peace officer". Is that our message?

Message from BSIS Chief Paul Johnson

The BSIS emailed out a message from Chief Paul Johnson today, where he reflects on his two-year anniversary with the Bureau and gives an update on the latest activities of BSIS.  Below is his message in its entirety:

This month will mark my two-year anniversary as Chief of the Bureau of Security & Investigative Services.  It continues to be a busy time as I travel around the state speaking at various industry functions.  One of my priorities lately has been to educate companies about the need to license their proprietary security employees as proprietary security officers (PSOs).  Slowly, but surely, the PSOs applications are rolling in.  Below is an update on the latest happenings here at the Bureau.

In March, our additional space was finished and we immediately took up residence.  Our Review Unit, Company Licensing Unit and a portion of our Enforcement Unit are now located on the new side.  Our Deputy Chief Rick Fong has been with us now for ten months.  Rick fits nicely with our Bureau.  He moves equally well between the various industries, attorney general's offices and Department and Bureau staff.

A new pocket guide for law enforcement has been in the works for a while now.  This pocket guide will assist peace officers and the public in identifying and verifying licenses and permits issued by the Bureau.  It is currently available for law enforcement.  In January, the Bureau began conducting scheduled and unscheduled statewide compliance inspections of security guard training requirements.  To date, we have made 305 site visits and response has been positive.

On May 9, 2007, a Rulemaking Package for the addition of training courses for security guards was completed.  This change adds seven new elective courses to the training syllabus, thereby providing private patrol operators with a greater choice of courses from which to choose.  In addition, the Powers to Arrest will now include four hours of Terrorism Awareness/Weapons of Mass Destruction Training.

On February 7th, the Bureau's Advisory Committee met in Riverside.  If a meeting can be judged by its turnout, we were quite a success!  A copy of the minutes is available on our Web site.  The next Committee meeting is tentatively scheduled for late fall - this time in the Bay Area.

Our Outreach Coordinator Rolando Taeza is getting some much needed help.  We have added another Outreach Coordinator, Fred Lopez, to help with the volume of requests Rolando is receiving.  We have conducted over 800 site visits in the past two years and licensee response continues to be very good.

Overall, I would say much progress has been made but there is still much more work ahead.  And keep an eye out - you just might see me on an outreach visit with Rolando.
